This Acceptable Use Policy ("AUP") outlines the permissible and prohibited uses of the services provided by Mantidae LLC, operating as Host443 ("Host443," "we," "us," or "our"), including dedicated hosting, GPU server, dedicated storage, and reverse proxy VPN services (collectively, the "Services"). This AUP is designed to protect our clients, our network, and the broader internet community. By using our Services, you agree to comply with this AUP.
1. General Conduct
Clients are expected to use the Services responsibly and lawfully. Any activity that violates applicable laws, regulations, or the rights of others is strictly prohibited.
2. Prohibited Uses
You agree not to use the Services for, or to facilitate, any of the following activities:
- Illegal Activities: Any activity that is illegal under the laws of the United States, the State of Nevada, or any jurisdiction where the Services are accessed or where your data is stored. This includes, but is not limited to:
- Child pornography or any content depicting the sexual abuse of minors.
- Terrorist activities or promoting terrorism.
- Fraud, phishing, or identity theft.
- Distribution of illegal drugs, weapons, or other contraband.
- Violation of export control laws.
- Spamming/Unsolicited Email: Sending unsolicited bulk email (UBE), unsolicited commercial email (UCE), or any other form of "spam." This includes, but is not limited to, sending mass unsolicited emails, email harvesting, or operating an an open SMTP relay.
- Network Abuse: Any activity that interferes with or disrupts Host443's network, services, or equipment, or the networks, services, or equipment of any third party. This includes, but is not limited to:
- Distributed Denial of Service (DDoS) attacks or participation in DDoS attacks.
- Port scanning, network probing, or vulnerability scanning without explicit prior written consent from the target.
- Interfering with or circumventing security measures of any system or network.
- Any activity that imposes an unreasonable or disproportionately large load on our infrastructure.
- Intellectual Property Infringement: Hosting, transmitting, or distributing any content that infringes upon the intellectual property rights of others, including copyrights, trademarks, patents, trade secrets, or other proprietary rights.
- Malware and Viruses: Distributing, hosting, or linking to malware, viruses, worms, Trojan horses, or any other destructive or disruptive code or programs.
- Phishing and Scams: Hosting or promoting phishing schemes, pyramid schemes, Ponzi schemes, or any other fraudulent activities.
- Resource Abuse: While our services are dedicated, any activity that intentionally or negligently causes excessive strain on our network or shared infrastructure (e.g., DNS servers, routing equipment) beyond reasonable dedicated use.
3. Permitted Content
Host443 is committed to providing a platform for diverse and private online activities. Therefore, the following content is generally permitted, provided it complies with all other aspects of this AUP and all applicable laws:
- Legal Adult Content: Hosting of legal adult content (e.g., pornography, erotic art) is permitted, provided it is not illegal in any jurisdiction where it is hosted or accessed, and it does not involve child exploitation, non-consensual acts, or any other illegal activities.
4. Compliance with Laws
You are solely responsible for ensuring that your use of the Services complies with all applicable local, state, national, and international laws, including but not limited to, data privacy laws (e.g., GDPR, CCPA), export control laws, and intellectual property laws.
5. Reporting Violations
If you become aware of any violation of this AUP, please report it immediately to us at abuse@host443.com. Please provide as much detail as possible, including relevant IP addresses, timestamps, and logs, to assist in our investigation.
6. Consequences of Violation
Host443 reserves the right to take any and all actions it deems appropriate in response to violations of this AUP, including, but not limited to:
- Issuing warnings.
- Suspending or terminating Services without refund.
- Removing or disabling access to offending content.
- Reporting illegal activities to appropriate law enforcement agencies.
- Charging administrative fees for handling AUP violations.
Host443's failure to enforce this AUP in every instance does not amount to a waiver of our rights.
7. No Monitoring
Host443 does not actively monitor the content or activities on its clients' dedicated servers or storage devices. However, we reserve the right to investigate any suspected violation of this AUP or our Terms of Service, including by reviewing your server logs or other relevant information, in response to a complaint or a legal request.
8. Changes to the AUP
Host443 reserves the right to modify this AUP at any time. We will notify you of any changes by posting the updated AUP on our website. Your continued use of the Services after such modifications constitutes your acceptance of the revised AUP.
